Terms of Service

1. Who we are

The Service is operated by NM Technology Services & Solutions (Grupo NMTSS), headquartered in Beira, Sofala, Mozambique. thibit is developed under Xibo Labs, the group’s product studio. You can reach us at legal@thibit.id.

2. The Service

thibit provides automated identity-signal analysis: it reads identity documents, evaluates authenticity signals, performs liveness and face-match checks, and returns a non-binding advisory assessment — no_material_concerns, manual_review_recommended, material_inconsistency, or assessment_incomplete — together with supporting evidence, over an API and hosted onboarding pages.

3. Advisory nature; your decision

Assessments are advisory signals, not decisions, guarantees, or legal determinations. You — the customer — remain responsible for your own onboarding, compliance, and business decisions, and for meeting your legal and regulatory obligations.

Use of the Service alone does not discharge any legal or regulatory duty, including customer due-diligence obligations under applicable anti-money-laundering and KYC law.

4. Accounts and API keys

You are responsible for your account, for the people you invite to it, and for keeping API keys and webhook secrets confidential. Keys are project-scoped and rotatable; rotate them immediately if you suspect exposure. Actions taken with your credentials are attributed to you.

5. Acceptable use

You agree to: verify individuals only where you have a lawful basis and have given any required notices; not use the Service for unlawful discrimination or surveillance; not probe, bypass, or interfere with the Service’s security or attempt to manipulate assessments; not resell or redistribute Service outputs without a written agreement; not use the Service to build a competing dataset or service; and to comply with applicable law in each market where you use the Service.

6. Customer data and privacy

How personal data is handled is described in the Privacy Notice. For the personal data of people you verify, you act as the data controller and thibit processes that data on your documented instructions.

7. Availability; pre-general-availability phase

The Service is currently in a pre-general-availability (testing) phase. It is provided "as is" and "as available"; features may change and no service-level commitment applies during this phase. We aim to give reasonable notice of material changes.

8. Fees

Any fees during the pre-general-availability phase are as separately agreed in writing. Published pricing, when introduced, will apply prospectively.

9. Intellectual property

The Service, the verification engine, documentation, and branding remain the property of NM Technology Services & Solutions and its licensors. You retain all rights in your data. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

10. Liability

To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, and the aggregate liability of NM Technology Services & Solutions arising out of or relating to the Service is limited to the amounts you paid for the Service in the twelve months preceding the event giving rise to liability.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Suspension and termination

We may suspend or restrict access where reasonably necessary for security, suspected abuse, or legal compliance. Either party may terminate at any time; on termination, verification evidence is deleted in line with the retention periods described in the Privacy Notice.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date; continued use of the Service after the update takes effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Republic of Mozambique, and disputes are subject to the competent courts of Mozambique, without prejudice to any mandatory protections available to you under local law.
